Introduction
These general terms and conditions apply to the contracts between the users of thebavarianguide.com and the provider.
1. Acceptance of bookings
The provider only accepts bookings from individuals with legal capacity. Legal entities must act through a duly authorized representative.
2. Truthful information
All information submitted via The Bavarian Guide platform must be accurate. The provider reserves the right to cancel bookings if incorrect information is provided. In such cases, the amount paid will not be refunded.
3. Arrive at the meeting point and comply with regulations
You are responsible for arriving at the meeting point on time. If traveling from abroad, you must ensure that you possess the necessary travel documents (passport, etc.) and comply with relevant health regulations.
4. Conditions of Participation
You are responsible for meeting all conditions of participation. The provider reserves the right to exclude participants who do not meet these conditions. No refunds will be issued in such cases.
5. Binding nature of the request
A contract between you and the provider is concluded when the provider accepts your booking request. By booking a tour, you make a binding offer that remains valid for two working days. If the provider accepts your offer within this time frame, the contract becomes binding. You will receive confirmation via email.
6. Payment
- 50% deposit required at the time of booking
- Final 50% payment due 4 weeks before the tour date
- Payment via bank transfer or credit card
- If booking with the promo code “earlybird” , full payment is due at booking time — with a 10% discount applied
7. Waiver of right of withdrawal
If applicable law provides for a right of withdrawal, you waive this right to the extent permitted by law.
8. Personal responsibility for insurance
The price does not include insurance. You are responsible for ensuring you have adequate insurance coverage, depending on the nature of the activity booked.
9. Unpaid Benefits
If you fail to pay for the booked service or reverse a payment, you forfeit your right to the service. This will be treated as a cancellation, and cancellation fees under Section 10 will apply.
10. Cancellation Policy
If you cancel tours, the following cancellation conditions apply:
- Free cancellation up to 28 days (4 weeks) before the tour
- 50% charge for cancellations 15–27 days before the tour
- 100% charge for cancellations 14 days or less before the tour or in case of no-show
- Please note that all incurred credit card transaction fees remain payable and are non-refundable in all cases. Additionally, all bookings during the world-famous Oktoberfest, as well as any bookings made at a discounted rate (including early-bird offers or other promotional prices), are strictly non-refundable.
11. Extraordinary cancellation
The provider may cancel the tour without notice if adverse weather conditions, government actions (e.g., COVID-19 lockdowns), or other unforeseeable and unavoidable events make it impossible, significantly more difficult, or unsafe to conduct the tour.
12. Exclusion of participation
The provider reserves the right to exclude any participant who fails to meet the conditions of participation, poses a risk to themselves or others, or seriously disrupts the tour. No refunds will be issued in these cases.
13. Program Changes
The provider reserves the right to make minor changes to the program if required by unforeseeable or unavoidable circumstances.
- In the event of a late arrival, the provider may shorten or modify the tour to ensure timely completion and avoid delays to subsequent tours. or shorten the tour so that the end of the tour is adhered to and the course of subsequent tours is not affected.
14. Time zone
The provider’s local time zone is decisive for all time-related matters and deadlines.
15. Liability of the provider of the tour or tourist service
The provider is liable for its services in accordance with applicable law. Liability is excluded to the extent permitted by law.
16. Changes to these Terms and Conditions
These terms and conditions may be changed at any time without notice. The version applicable to your booking is the one in effect at the time of booking. There is no entitlement to future bookings under the same terms.
17. Other provisions
These terms constitute the entire agreement between you and Sepp, The Bavarian Guide. No additional agreements exist.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer residing in another country at the time of your booking, mandatory provisions of that country remain applicable. The exclusive place of jurisdiction is Germany, unless otherwise required by law.
If any provision of these terms is or becomes invalid, the validity of the remaining provisions remains unaffected.
