Introduction
These general terms and conditions apply to the contracts between the users of thebavarianguide.com and the provider.
1. Acceptance of bookings
The provider only accepts bookings from persons capable of acting. Legal entities must act through a duly authorized person.
2. Truthful information
The information submitted via TheBavarianGuide platform must be truthful. The provider reserves the right to cancel bookings if incorrect information is provided. In this case, the price paid cannot be refunded.
3. Arrive at the meeting point and comply with regulations
You are responsible for arriving at the meeting point on time. If you are traveling from abroad for the activity, you are responsible for obtaining the necessary travel documents (passport, etc.), complying with health regulations, etc.
4. Conditions of Participation
You are responsible for compliance with any conditions of participation. The provider reserves the right to exclude participants from the activity who do not meet these conditions. In this case, the price paid cannot be refunded.
5. Binding nature of the request
The contract between you and the provider is concluded when the provider accepts your request. By booking a tour, you make a binding offer to the provider, to which you are bound for 2 working days. If the provider accepts your offer within this period, the contract is definitely concluded. You will receive this notice by email.
6. Payment
The provider offers the following payment methods: bank transfer, credit card and PayPal
7. Waiver of right of withdrawal
If the law applicable to the contract between you and the tourist service provider provides for a right of withdrawal in your favor, you waive this right to the extent permitted by law.
8. Personal responsibility for insurance
The price does not include insurance. You are responsible for ensuring that you have sufficient insurance cover. The insurance requirement depends on the activity booked.
9. Unpaid Benefits
If you do not pay for the booked service or cancel the payment, you will no longer be entitled to the services. This is considered a cancellation and the cancellation costs in accordance with Section 10 will be payable.
10. Cancellation Policy
If you cancel (cancel) tours, the following cancellation conditions apply:

12. Exclusion of participation

In these cases, the price paid cannot be refunded.
13. Program Changes
The provider also reserves the right to make minor program changes if this becomes necessary due to unforeseeable or unavoidable circumstances.
14. Time zone
The provider’s time zone is decisive for time and deadline calculations.
15. Liability of the provider of the tour or tourist service
The provider is liable for its services in accordance with applicable law, although liability is excluded to the extent permitted by applicable law.
16. Changes to these Terms and Conditions
These terms and conditions are subject to change at any time and without notice. The conditions valid for each individual booking apply. The user has no right to have future bookings completed according to existing conditions.
17. Other provisions
These Terms and Conditions are the entire agreement between Sepp, The Bavarian Guide and the user. There are no other additional agreements.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you placed the order as a consumer and have your habitual residence in another country at the time of your order, the application of the mandatory legal provisions of that country remains unaffected by the choice of law made in sentence 1. The exclusive place of jurisdiction is Germany. Legally mandatory jurisdictions remain unaffected.
Should provisions of these General Terms and Conditions be or become invalid, this will not affect the effectiveness of the remaining provisions.
