Terms and Conditions

Introduction
These Terms & Conditions govern the contractual relationship between The Bavarian Guide and all customers booking tours, purchasing digital products, gift certificates, travel planning services, or any other products and services offered through thebavarianguide.com.
By making a booking or purchase, you agree to these Terms & Conditions as well as my Cancellation & Refund Policy, Privacy Policy, and any additional conditions applicable to the selected product or service.
1. Acceptance of bookings
The provider only accepts bookings from individuals with legal capacity. Legal entities must act through a duly authorized representative.
2. Truthful information
All information submitted via The Bavarian Guide platform must be accurate. The provider reserves the right to cancel bookings if incorrect information is provided. In such cases, the amount paid will not be refunded.
3. Arrive at the meeting point and comply with regulations
You are responsible for arriving at the meeting point on time. If traveling from abroad, you must ensure that you possess the necessary travel documents (passport, etc.) and comply with relevant health regulations.
4. Conditions of Participation
You are responsible for meeting all conditions of participation. The provider reserves the right to exclude participants who do not meet these conditions. No refunds will be issued in such cases.
5. Binding nature of the request
A contract between you and the provider is concluded when the provider accepts your booking request. By booking a tour, you make a binding offer that remains valid for two working days. If the provider accepts your offer within this time frame, the contract becomes binding. You will receive confirmation via email.
6. Payment
All prices displayed on this website or quoted individually are stated in the applicable currency and include the services expressly listed in the relevant product description, booking confirmation, or personalized offer.
Additional services requested after your booking has been confirmed—including itinerary changes, additional participants, extra hours, tickets, or special arrangements—may incur additional charges. Any such costs will always be communicated and agreed upon before they become payable.
Payment Schedule
Unless otherwise stated in the individual offer or product description:
- A 20% non-refundable deposit is required to secure all private tour bookings made directly through The Bavarian Guide.
- The remaining 80% balance is due no later than 100 days before the scheduled tour date.
- Bookings made within 100 days of the tour date require full payment at the time of booking.
Immediate Payment Required
Full payment is required at the time of purchase for:
- Easter holiday bookings
- Oktoberfest experiences
- Christmas and New Year experiences
- Promotional or discounted bookings
- Early Bird offers
- Bookings made using promotional or coupon codes
- Gift Certificates
- Travel Planning services
- Digital travel guides
- Downloadable itineraries
- Personalized digital products
- All other digital products and services
Accepted Payment Methods
Payments may be made using the payment methods offered during checkout, including:
- Credit or Debit Card
- PayPal
- Bank Transfer
- Stripe
- Other approved online payment providers
Please note that exchange rates, foreign transaction fees, bank charges, PayPal fees, Stripe fees, and other payment provider charges are determined by the respective financial institution or payment provider and are outside the control of The Bavarian Guide.
In the event of an obvious pricing, calculation, or typographical error, I reserve the right to correct the error before accepting or fulfilling the booking. In such cases, you will be contacted and given the opportunity to proceed at the correct price or cancel your booking without obligation.
7. Cancellation & Refund Policy
All cancellations, refunds, payment terms for digital products, gift certificates, promotional bookings, and withdrawal rights are governed by my separate Cancellation & Refund Policy, which forms an integral part of these Terms & Conditions.
By completing a booking or purchase, you acknowledge that you have read and accepted the Cancellation & Refund Policy.
8. Provider’s Right to Cancel or Modify a Tour
The provider may cancel the tour without notice if adverse weather conditions, government actions (e.g., COVID-19 lockdowns), or other unforeseeable and unavoidable events make it impossible, significantly more difficult, or unsafe to conduct the tour.
9. Exclusion of participation
The provider reserves the right to exclude any participant who fails to meet the conditions of participation, poses a risk to themselves or others, or seriously disrupts the tour. No refunds will be issued in these cases.
10. Program Changes
The provider reserves the right to make minor changes to the program if required by unforeseeable or unavoidable circumstances.
- In the event of a delayed start caused by the guest, the itinerary may be adjusted or shortened to ensure the tour concludes at the agreed time and does not affect subsequent bookings.
11. Time zone
The provider’s local time zone is decisive for all time-related matters and deadlines.
12. Liability of the provider of the tour or tourist service
The Bavarian Guide is liable only to the extent required by applicable German law. Liability for slight negligence is excluded where legally permissible. Nothing in these Terms limits liability for intent, gross negligence, personal injury, or any liability that cannot legally be excluded.
13. Changes to these Terms and Conditions
These terms and conditions may be changed at any time without notice. The version applicable to your booking is the one in effect at the time of booking. There is no entitlement to future bookings under the same terms.
14. Other provisions
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms & Conditions constitute the entire agreement between you and The Bavarian Guide regarding your booking or purchase unless otherwise agreed in writing.
